# Your Rights as an Insurance Policyholder

When you buy a policy from any insurance company, you are not just paying a premium — you are entering a contract that comes with legal protections. Insurance is one of the most heavily regulated industries in the country, and both Missouri and Kansas have departments whose entire job is to look out for policyholders. At BNW Services LLC (dba InsureToday24), we think every household and small-business owner we serve should know these rights, because an informed customer makes better decisions.

Here is a plain-spoken walk through what you are entitled to.

The Right to Be Insured by a Licensed Company and Agent

Every insurance carrier doing business in Missouri or Kansas must be licensed by that state's regulator — the Missouri Department of Commerce & Insurance or the Kansas Insurance Department. Every agent and agency must hold a valid license too.

You have the right to verify this. You can look up any agent, agency, or company on your state department's website before you buy. BNW Services is a licensed independent insurance agency in Missouri and Kansas, and you are always welcome to confirm our standing. (See our companion article, "Is BNW Services Licensed? How to Verify Your Agent.")

The Right to a Clear Explanation of Your Coverage

You have the right to understand what you are buying. That means an agent should explain — in language you can follow — what your policy covers, what it excludes, your deductibles, your limits, and what you pay.

As an independent agency, we shop the carriers we represent and walk you through the differences. You should never feel pressured into a product you do not understand. If something is unclear, ask. That is what we and Lucy, our AI receptionist at (573) 594-5148, are here for.

The Right to a Copy of Your Policy and Honest Disclosure

You are entitled to receive a copy of your full policy and any endorsements. You also have the right to honest, accurate information. State law prohibits agents and carriers from misrepresenting policy terms, making false statements to get you to switch policies, or hiding material facts. If a claim is later denied, you have the right to a written explanation of why.

The Right to Fair Claims Handling

This is one of the most important protections you have. Both Missouri and Kansas have unfair claims settlement practices rules that require carriers to:

You have the right to deal with an adjuster who treats you fairly, and you have the right to ask questions about how your settlement was calculated. If your vehicle or home is declared a total loss, you have the right to understand how the actual cash value was determined.

The Right to Appeal a Denial

A denial is not always the final word. You have the right to ask the carrier to reconsider, to provide additional documentation, and to escalate. If you believe a claim was handled unfairly, you can file a complaint with the Missouri Department of Commerce & Insurance or the Kansas Insurance Department. These departments review consumer complaints and can intervene with carriers on your behalf.

The Right to Proper Notice Before Cancellation or Non-Renewal

A carrier generally cannot cancel your policy on a whim. State rules require advance written notice before a cancellation or non-renewal, and the carrier must state the reason. This gives you time to fix an issue, pay a missed premium, or shop for replacement coverage. (See "What Happens If You Miss an Insurance Payment.")

The Right to Privacy

Under federal law — the Gramm-Leach-Bliley Act, overseen in part by the FTC — your insurer and agency must protect your personal financial information and tell you how it is used and shared. You have the right to know what data we collect and how we safeguard it. (See "How We Protect Your Personal Information.")

The Right to Guaranty Fund Protection

If a licensed insurer becomes insolvent, state guaranty associations exist to protect policyholders up to certain limits. These nonprofit safety nets are operated at the state level, with model frameworks and coordination provided nationally through the NAIC. They are one more reason buying from a licensed carrier matters — there is a backstop if the unexpected happens.
